When an employee can apply for maternity leave?


According to the Maternity Benefit (Amendment) Act 2017, there are some changes under the law, where the paid maternity leave in India is increased from 12 weeks to 26 weeks for expectant women employees starting from up to 8 weeks before the expected date. 


For a woman employee to be eligible under this Act, she should have completed working for 80 days in the current establishment in the last 12 months.


The maternity leave payment is at the rate of the average daily wage for the period of absence and further benefits will be unchanged as per company HR policies.
